Dormer Harpring is proud to announce a $2,200,000 jury verdict for our client, Lisa, on Friday, September 18, 2026, in the District Court of Arapahoe County after she suffered a serious head injury and ongoing neck injuries in a preventable fall at her community pool.
Background:
Our client, Lisa, is a 52-year-old single mom who was enjoying the community pool where she lived when a lifeguard asked her to help let another lifeguard through the pool gate. Lisa climbed out of the pool and, still wet and barefoot, walked toward the gate.
Around the pool, the deck had a rough, gritty texture. But as Lisa approached the pool gate, the surface unexpectedly transitioned to smooth, polished concrete. None of the Defendants in the case could explain why the surface near the gate was different from the surrounding pool deck.
When Lisa stepped onto the smooth, polished surface, she slipped and fell backward, striking the center of her skull on the concrete. EMTs responded to the scene and diagnosed Lisa with a head injury accompanied by dizziness, as well as a neck injury. She was transported by ambulance to the emergency room that night.
For the last three years, Lisa has continued to receive treatment for her concussion and post-concussion syndrome, along with her ongoing neck injury.
The evidence presented at trial showed that Front Range Recreation, Inc., the pool management company for the property, knew the surface near the pool gate was slicker than the surrounding area. The jury also heard evidence that a lifeguard had previously seen people fall in the same area.
Despite this knowledge, Front Range failed to take reasonable steps to address the dangerous condition. The jury determined that even a simple precaution, such as placing a rubber mat over the slick, polished concrete, could have helped prevent Lisa’s injuries.
After hearing a week’s worth of evidence, the jury found Front Range Recreation, Inc. responsible for Lisa’s injuries. The jury determined that Front Range knew or should have known that the smooth, polished concrete at the pool entrance gate created a dangerous condition and that Front Range failed to act reasonably to prevent an injury like Lisa’s.
The jury also heard from Lisa’s physician, who described the lifelong care she will need to treat her ongoing symptoms. After considering the evidence and the significant damages Lisa suffered, the jury returned a verdict totaling $2,200,000.
At the end of the week-long trial, the jury agreed that Lisa’s injuries were preventable and that Front Range had a duty to take proactive, reasonable steps to protect people using the pool area from the dangerous condition.
From everybody at Dormer Harpring, we are deeply grateful to the jury for their service and for holding the Defendant accountable. We are also grateful to our courageous client, Lisa, who remained resilient and showed tremendous strength throughout the entire process.
